Terms & conditions

These terms and conditions govern the relationship between the customer and the seller. By using the website of the seller, by making reservations or orders, the Customer accepts these terms and conditions.

1. Identity of seller

Not having been able to examine the items before you buy them, it is indeed a distance selling. This implies that the Customer has a cooling-off period of 14 days (see item 7). Therefore, if an item does not meet expectations, the Client may decide to give up his command.

3. Supply and assortment

Photos are available on the website of the Seller for purely illustrative and decorative and can contain elements that are not included in the price or different from the article.

The offer is valid while stocks last and can be changed at any time by the Seller. It is also always made with the utmost care. Seller reserves the right to refuse orders or reservations

  • In case of strong suspicion of abuse of law or bad faith on the part of the customer

4. Price

Prices refer exclusively to the article as described verbatim. All prices include VAT. Additional shipping costs, booking or other mandatory administrative expenses are shown separately.

The goods ordered at the place indicated by the Client will incur a surcharge, as shown in the table below

6. Shipping

The goods subject to the control is provided by a third party carrier. The seller shall make every effort to collect the goods ordered or reserved in time depending on availability. The delivery dates are not binding. If the delivery date had to be changed, the seller will notify the customer.

Reservations may be withdrawn at the registered office of the Seller located Grand'Route, 191 - 4400 Flemalle. The items will remain available to the customer for 14 days, after which time, if not removed, the booking will be canceled without any charge.

Orders are delivered on schedule, at the door (ground floor) at the address indicated by the Customer. It is responsible for any (un) investment or retrofitting. The driver / delivery person can claim an identity in the delivery room. The risk of loss or damage is transferred to you upon delivery of the goods. The general conditions of the carrier also apply to the delivery of items ordered.

In the absence of the customer on delivery, the Seller reserves the right to charge the costs resulting from the performance.

If the customer wishes, the Orders may also be removed at the registered office of the seller located Grand'Route, 191 - 4400 Flemalle by the Client.

7. Warranty

Legal guarantee

The legal guarantee for consumers is 2 years. This warranty covers only the non-compliance that existed on delivery of goods. During this period, we undertake to replace or repair the defective product without charge (or one of its components). We reserve the right to exchange the item if repair costs disproportionate or impossible to repair. Defects that occur after a period of six months from the date of delivery are not presumed to be present at time of delivery, unless proved otherwise by the customer.

Commercial warranty

Some items are covered by a commercial warranty. No commercial warranty does not affect the warranty. Unless otherwise stated, the commercial warranty begins on the date of entry into force of the legal guarantee. Warranty conditions

To claim a warranty, the Customer must provide proof of purchase, receipt or invoice. The warranty is not transferable. During the warranty period, all defects must be reported within two months following its discovery. After this period, the Customer forfeits any right to repair or replacement.

Exceptions 

The warranty does not cover defects resulting from accidents, a condition aggravated by neglect, falls, use of the article does not conform to the intended use, failure to follow instructions of or use the manual adjustments or modifications to the device, a brutal use, improper installation, improper maintenance or abnormal use, commercial or incorrect.

It does not apply to articles to shorter life (eg, batteries, wear items or products that have an earlier deadline) or in case of intervention of a third party not recommended by the Seller.

8. Right of withdrawal

This section applies only to orders.

The Customer has the right to notify the Seller waives the purchase without penalty and without giving any reason, within 14 calendar days from the day following delivery of the item ordered.

This delay allows the customer to consider the item purchased, as in a store. During this period, the Customer must handle the purchased item with the necessary care. The Customer may not unpack the item if it is necessary to exercise the right of inspection. The item purchased can only be returned in its original condition.

If the item is no longer salable and that Customer does not limit itself to the mere inspection (using an electric toothbrush, a coffee maker, etc.), it is fully charged to the Customer (including articles where hygiene is important).

This right of cancellation does not apply to items that are clearly of a personal nature.

The article does not meet the expectations of the customer? It can:

9. If payment is

In case of non-payment at maturity, default interest of 1% per month are due by right and without notice and from the day following the expiry of the payment. Without prejudice to interest, potential legal costs and any other law, a failure of payment at maturity ipso facto the payment of a contractual indemnity fixed at 10% of total purchases at the rate of a minimum of  62.00 €.

10. Recovery

Seller offers the client the opportunity to resume the old electrical and electronic equipment with the purchase of a new device of the same type. If he wishes to use the service, the customer must notify the seller no later than four days before delivery.

11. Claims

Any visible damage, while qualitative defect articles and / or other failure on delivery must be reported immediately, on pain of extinction of any right in this regard.

12. Respect for privacy

Seller agrees to use the contact Customer exclusively for sending communications of SA-Pauwels Jamotte and / or ensure correct processing of the contract with the Client. These details will be stored in the list of customers and the Seller will be kept strictly confidential. The customer can view, modify or correct at any time or ask us not to use them. 13. General provisions

Severability: The fact that any provision of these Terms is invalid, illegal or void will not in any way affect the validity, legality or enforceability of the remaining provisions.

Disclaimer: The fact that the Seller's failure to insist upon strict enforcement of any provision of these Terms shall be considered as an implied waiver of his rights established in the above conditions and does not prevent any of the later require Strict compliance with these provisions.

Changing conditions: The Seller reserves the right at any time to modify these terms without notice. Conditions that were applicable at the time of the sale still apply for contracts. Any reservation and / or Command performed after changing implies acceptance of these new conditions.

Conditions may be supplemented by other conditions if there is an explicit reference.

Order of precedence of documents: In the event of inconsistency between these Conditions and the Special Conditions, the Special Conditions shall prevail.

Internet risks: The Customer knows the limitations and risks of using the Internet or other means, now and in the future, to have the web site. He also knows the risks of storage and transfer of digital or electronic information. He agrees that Seller is not liable for any damage resulting from the aforementioned risks associated with the use of our websites or the Internet.

Proof: The Customer agrees that communications and electronic safeguards can be used as evidence.

14. Applicable law - jurisdiction

Belgian law is applicable, with the exception of the rules of private international law. Only the courts of Liege are qualified in litigation.
